Nebraska: WC Court proposes 6 revisions for rules of procedure

A public hearing was scheduled for Dec. 15, 2009, to accept testimony regarding the adoption of the revised rules of court procedure.

The Workers' Compensation Court proposed the following revisions: 1) amend Rule 16, Briefs, to provide that briefs filed with the clerk of the court shall not be confidential, and filed briefs will not contain material declared by statute or rule to be confidential; 2) amend Rule 26, Schedules of Fees for Medical, Surgical, and Hospital Services, to adopt revised fee schedules and revise dates; 3) repeal Rule 46, Settlement Agreements; 4) amend Rule 47, Lump Sum Settlements, to revise the application procedures and include additional settlement application requirements; 5) amend Rule 48, Informal Dispute Resolution, to provide that a certified vocational rehabilitation counselor may request informal dispute resolution and to eliminate certain requirements regarding dispute resolution; and 6) amend Rule 50, Choice of Physician, to revise written notice requirements and eliminate the requirement that a request for informal dispute resolution must be submitted if the employee and employer cannot agree on a change of physician.
