New York: Updated billing procedure brings fines

The Workers' Compensation Board has begun assessing procedural penalties to any parties or regulated entities who fail to comply with the state's workers' compensation statutory or regulatory provisions.

As part of the state's 2009 updated billing process, parties with unpaid procedural penalties received a bill for past-due penalties dating back to 2003, along with an offer of settlement. Starting the second quarter of 2010, those with an outstanding workers' compensation claim penalty will receive a statement of unpaid penalties every three months. The statements will include any unpaid balances from previous statements, including those who chose not to take advantage of the WCB's offer of settlement in 2009. Because the time to contest penalties will have expired by the time the statement is issued, procedures for questioning the application of payments or individual penalties will also be included. Delinquent balances will be subjected to additional interest and can include up to a 22 percent collection fee as allowed by New York State Finance Law.
