Colorado: Division schedules hearings, makes proposed changes available

The Division of Workers' Compensation will hold public hearings prior to the adoption of proposed amendments to the Workers' Compensation Rules of Procedure, 7 C.C.R. 1101-3 Sections 8-47-107, 8-44-112 and 8-46-102.

On June 14, the DWC will discuss changes to Rule 8-8, which would amend the current rule requiring audio recording of certain independent medical examinations for claims filed on or after Aug. 5, 2009. The proposed changes will bring the rule in line with newly adopted legislation that will make the audio recordings apply to all claims. On June 15, the DWC will allow the public to comment on the addition of a subsection to Rule 5-14, which outlines the form and manner for conducting surveys. On June 16, the DWC will consider the addition of Rule 7-4, which adds a new subsection establishing a single life expectancy table as required by legislation. On June 21, a public hearing will be held on amendments to Rule 11-3, which sets up a system to allow a selected physician performing a DWC independent medical examination to provide a summary disclosure of certain financial and business interests. All public hearings will take place at 9 a.m. on their respective dates in the second-floor conference room of the DWC's offices in Denver. The proposed rule changes are available on the DWC's Web site, and regulatory analysis of the changes will be available beginning June 7. For additional information, visit www.coworkforce.com/dwc.
