New York: New maximum weekly benefit rate to take effect

Beginning July 1, in accordance with New York State Workers' Compensation Law Section 2(16), the maximum weekly benefit rate for workers' compensation will be two-thirds of the state's average weekly wage for the previous calendar year as determined by the Department of Labor.

The Department of Labor's Research and Statistics Division has calculated the average weekly wage for calendar year 2009 at $1,109.75. This sets the maximum weekly benefit rate at $739.83 for workers' compensation claims with dates of accident or dates of disablement that fall between July 1, 2010 and June 30, 2011.
