Tennessee: Division to amend drug-free workplace program rule

The Workers' Compensation Division proposed an amendment to a rule on the drug-free workplace programs.

The amended rule adds heroin and Ecstasy to the drug-testing program. The rule also decreases the cut-off levels for amphetamines and cocaine. The rule requires collection to be made using the split sample method. The rule prohibits an inference or presumption of intoxication or impairment to be made when a physician prevents a specimen collection based on his medical expertise. The same rule is currently in effect through April 2 as an emergency rule. The proposed rule takes effect March 31.
