The commission added factors upon which to base attorney's fees, including: 1) the likelihood that the acceptance of the particular employment will preclude other employment by the lawyer; 2) the fee customarily charged in the locality for similar legal services; 3) the time limitations imposed by the claimant or the circumstances; 4) the nature and length of the professional relationship with the claimant; 5) the experience, reputation, and ability of the lawyer performing the services; and 6) whether the fee is fixed or contingent. The rule requires the representative to file a copy of the written fee agreement. If the fee agreement is a contingency fee agreement, the commission will inquire as to whether the contingency that is the basis for the matter occurred.
