South Carolina: Commission revises method to request hearing

The Workers' Compensation Commission revised its form for employers requesting a hearing.

The revisions add pleadings provided by the statute and regulations. The commission changed the form to expand use of the form rather than submitting motions. The form was changed to require a hearing within 60 days if the employer requests to stop payment of compensation. If a hearing is requested to determine whether compensation is due, the employer must attach a copy of the medical report finding that the worker reached maximum medical improvement. In requests for a hearing to determine the amount of compensation due for claims involving a fatality, a dependency investigation must be attached to the form. The new form is available on the division's website.
