Texas: Division seeks to outline payment of income benefits

The Division of Workers' Compensation informally proposed rules to establish a procedure by which an insurance carrier can recoup an overpayment of income benefits from future payments or pay an underpayment of income benefits.

The rules require an injured worker to notify an insurance carrier in writing if he determines that he received less than the correct amount owed. An insurance carrier must notify an injured worker in writing if it will begin withholding benefits to recoup an overpayment. Comments were accepted until Oct. 5. The rules are required to be adopted by Jan. 1, 2012.
