New York: Fee schedule rule about to expire

The Workers' Compensation Board adopted an emergency rule regarding pharmacy and durable medical equipment fee schedules, the process for payment of pharmacy bills, and the requirements for designated pharmacies.

The rule provides definitions for average wholesale price, brand name drugs, and generic drugs. The rule sets forth a transition period for injured workers to transfer prescriptions to a designated pharmacy or pharmacy network. The rule allows claimants to fill prescriptions by the Internet or mail order. The rule went into effect on Sept. 9 and will expire on Dec. 7.
