Maine: Deadline for comments on 14-day rule approaching quickly

The Workers' Compensation Board proposed amendments to the 14-day rule.

The amendment specifies to whom notice of a claim for incapacity benefits must be made. If a notice of controversy is not filed within 14 days of a claim for incapacity, benefits must be paid from the date the claim is made. The rule specifies that a violation ends when a notice of controversy is filed and benefits are paid. Also, a payment obligation ends even if the average weekly wage or compensation rate was calculated incorrectly as long as the payment was reasonable and based on information gathered at the time of the payment.
