Ohio: Bureau spells out provider decertification process

The Bureau of Workers' Compensation proposed new provider decertification procedures.

The rule sets forth a "progressive discipline" path for violations of a workers' compensation statute or rule, or a term of the provider application and agreement or recertification application and agreement, providing for written notice and submission of a correction plan prior to decertification.

Providers decertified pursuant to the "progressive discipline" path are eligible to apply for and be considered for recertification two years from the date of the final administrative or judicial order of decertification. Certain violations would be excepted from the "progressive discipline" path and proceed directly to decertification. Providers excepted from this "progressive discipline" path are not eligible to apply for and be considered for recertification.

The rule also provides that the bureau may waive strict application of the "progressive discipline" path to an individual provider based on the presence of mitigating circumstances.
