South Carolina: Commission issues proposed reg on mediation

The Workers' Compensation Commission proposed a new regulation regarding mediation to resolve disputes without a hearing.

The proposed regulation would not create a mandatory system for mediations but would authorize the commission to order mediation for certain cases in the workers' compensation system. Certain claims, including occupational disease cases, contested death claims, and mental/mental injury claims must be mediated prior to a hearing. The rule states that the parties share the cost of the mediation equally, unless otherwise agreed by the parties or ordered by the commission. The commission accepted comments until March 26.
