Illinois: New rules on alcohol and drug testing on the table

The Workers' Compensation Commission proposed new rules regarding alcohol and drug sample collection and testing.

The rules implement a statutory amendment that provides that an injured worker will not receive workers' compensation benefits if his intoxication is the proximate cause of his accidental injury or if at the time he incurred his injury he was so intoxicated that the intoxication constituted a departure from the employment. The rules set forth the process for the collection of blood, urine, breath, and saliva of injured workers. The rules also include requirements for documentation, transportation, and disposal of samples collected, as well as associated records. The rules also set forth the qualifications for those collecting samples. Comments were accepted.
