Maryland: Commission focuses on average weekly wage amendments

The Workers' Compensation Commission proposed an amendment to a rule regarding the procedure and timeline for determining the average weekly wage.

The rule states that the AWW must be adjudicated at the first hearing before the commission. And if the commission finds that an inaccurate weekly wage resulted in an overpayment or underpayment of benefits, it can order a credit against future permanent disability benefits, the payment of additional compensation, or any other relief the commission determines is appropriate.
