Maine: Board proposes rules of appellate division

The Workers' Compensation Board proposed rules establishing rules of procedure before the appellate division of the board.

The rules provide that the executive director of the board must appoint an appellate panel of at least three full-time hearing officers. The rules also set the time for filing a notice of intent to appeal a hearing officer's decision. The appellant must prepare the record on appeal and pay the cost of producing the record, including the transcript. The appellant has 30 days after the date the record is filed to file a brief.

Unless otherwise ordered, five copies of each brief must be filed with the division and one copy of each brief must be served on the counsel or advocate for each of the other parties separately represented. The rules set out requirements for the contents of briefs. The rules also provide requirements for oral arguments. The board accepted comments until Dec. 6.
