Missouri: Legislative leaders will again seek workers' comp changes
Gov. Jay Nixon last year rejected the idea, saying he opposed eliminating the right of workers to sue their employers for work-related diseases. With an incoming Republican majority in the state Legislature, legislators say they will again raise the issue.
The Missouri Chamber of Commerce says Missouri is the only state where workers' comp is not the exclusive means of resolving claims over occupational diseases. Republican leaders want to change that.
A law in 2005 has led to legal cases in which courts have held that claims over occupational diseases did not have to go through the workers' comp system. Business advocates say the law needs to be changed to protect employers from having to defend themselves against occupational disease claims in court.
